Processing Requests

Do you need help with your backlog or with a particular request?

Marcel Gauthier has extensive knowledge of, and experience in:

 

interpreting and applying the legislation, policy and guidelines; and
 

 

all Access to Information and Privacy (ATIP) related matters and processes.
 

He can provide all services required for processing requests, including large and/or complex requests, such as:

 

consulting with requesters and program officials to define the scope of requests, and identifying and dealing with their concerns regarding the processing of requests;
 

 

documenting the processing activities and the rationales for positions and decisions;
 

 

identifying and analysing sensitive issues, elucidating intricate issues and seeking legal opinions;
 

 

consulting senior officials representing various levels of government, notifying senior officials or lawyers representing third parties, and identifying and dealing with their concerns;
 

 

identifying exempt or excluded information, and the required supporting rationales;
 

 

identifying matters that are likely to elicit reactions from the public, interest groups and media, and preparing or assisting in the preparation of the institution's response;
 

 

consulting and briefing the institutions senior officials (including Minister and Deputy Minister); and
 

 

dealing with investigations by either of the Commissioners, and with appeals to the Federal Court.
 

     


Studies, Reviews and Assessments

Do you need reviews, studies or impact assessments of existing or proposed processes, practices, positions or resources?

The following are examples of available services:

 

planning project;
 

 

information gathering on any ATIP related matters, including proposed or existing processes, practices, positions, systems and resources;
 

 

detailed examination and analysis of information gathered;
 

 

identification of possible options;
 

 

identification of consequences of maintaining the status quo, and of proposed actions or decisions;
 

 

recommendations as to best solutions based upon all pertinent considerations such as legal requirements, available resources, delegation, etc ...;
 

 

preparation of appropriate flow charts, schedules and other management tools; and
 

 

preparation of complete and useful reports.
 

     


Directives

Do you need policy, procedures, guidelines or other tools for implementing the legislation?

Prior to entering the ATIP field, Marcel Gauthier worked in directives management at Agriculture and Agri-Food Canada.  He was responsible for providing corporate advice on the preparation of directives and manuals, and for publishing the corporate administration manual.  While working in ATIP, he developed directives pertaining to this legislation for Agriculture and Agri-Food Canada, and for Indian and Northern Affairs Canada.  He also drafted directives under contract for Health Canada.

The following are examples of available services:

 

planning project;
 

 

researching and compiling relevant documentation;
 

 

interviewing and/or conducting group discussions with client and other subject experts;
 

 

identifying who requires directives (audience);
 

 

determining why directives are required (objective);
 

 

establishing what directives are required, and identifying the medium and format (tools to achieve objective);
 

 

preparing flow charts and otherwise documenting the existing and/or proposed principles, processes, practices, standards and criteria (analysis of what exists or is proposed);
 

 

reviewing these with client, subject experts and with those who will be using directives;
 

 

drafting modular directives, forms and other documentation in the most appropriate formats to direct, inform and assist officials in carrying out their duties and functions (creation of tools);
 

 

reviewing these with client, subject experts and with those who will be using these tools; and
 

 

preparing final directives according to client's instructions.
 

     


Staffing

Do you need help with any of your staffing actions?

The following are examples of available services:

 

preparing job desciptions, and statements of qualifications;
 

 

preparing questions, scenarios, answers, other rating instruments, and a rating guide; and
 

 

participating as a board member for the competition.
 

     


Team Leader

Do you need someone to provide advice and guidance to ATIP officers?

The following are examples of available services:

 

identifying strenghts and weaknesses of team members;
 

 

reinforcing and making full use of strenghts;
 

 

coaching or directing team members as appropriate; and
 

 

monitoring and reviewing their work to ensure compliance to the ATIP legislation, including the application of exemptions and exclusions, and meeting legal deadlines.
 

     


Privacy Impact Assessments

Do you need someone to complete a Preliminary Privacy Impact Assessment (PPIA) or a Privacy Impact Assessment (PIA)?

The following are examples of available services:

 

planning project;
 

 

researching and compiling relevant documentation;
 

 

interviewing and/or conducting group discussions with client and other subject experts;
 

 

identifying the types and volumes of personal information that are to be collected, used and disclosed;
 

 

verifying the legislative and policy authorities for the proposed program or service;
 

 

determining which aspects of the program or service are likely to involve privacy risks;
 

 

preparing any appropriate flow charts and other management tools required for the assessment;
 

 

reviewing all relevant information with client, and subject experts;
 

 

initiating the consultation process with the Office of the Privacy Commissioner;
 

 

preparing a report containing all information required by the policy:
 

     

an outline of the proposal involving the collection, use or disclosure of personal information and its objectives, including the legal authority and the justification for the proposal;
 

     

a list of stakeholders and their roles and responsibilities;
 

     

a list of relevant legislation and policies that have implications for privacy and the protection of personal information;
 

     

a description of specific privacy risks that have been identified;
 

     

an analysis of options considered to avoid or mitigate privacy risks;
 

     

a list of residual risks that cannot be resolved by means of the proposed options and an analysis of possible implications of these risks in terms of public reaction and program success; and
 

     

a communications strategy, where appropriate, to deal with public concerns and perceptions about privacy.
